Terms of Service

1. Acceptance of terms

By creating an account or using Sharpnd. (“the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including those on the free tier and those with a paid Pro subscription.

2. Description of service

Sharpnd. is a golf practice tracking application that helps amateur golfers log rounds, receive targeted practice recommendations, and track improvement across four skill areas. The Service is available at sharpnd.io and any associated mobile applications.

3. Free and Pro tiers

Sharpnd. is available on a freemium basis:

• Free tier — access to core features including round logging, drill quests, XP tracking, streaks, and leaderboards. Some features are restricted (see in-app feature list). No credit card required.
• Pro tier — includes all Free tier features plus AI-generated practice plans, advanced analytics, full contribution history, streak freeze tokens, drill swaps, and weekly missions. Pro is accessed via a paid subscription.

Feature availability for each tier may change over time. We will notify Pro subscribers in advance of any material reductions to Pro features.

4. Subscription and billing

Pro subscriptions are billed on a recurring basis (monthly or annual, as selected at checkout). By subscribing, you authorise us to charge your payment method on each billing cycle until you cancel.

• Prices are displayed in USD and are subject to change. We will give at least 30 days' notice before raising prices for existing subscribers.
• Subscriptions automatically renew unless cancelled before the next billing date.
• Payments are processed by Stripe or RevenueCat depending on your platform. We do not store your payment card details.
• All charges are non-refundable except where required by applicable law.

5. Cancellation

You may cancel your Pro subscription at any time from your profile settings or by contacting us at info@sharpnd.io. Cancellation takes effect at the end of the current billing period. You will retain Pro access until that date. After cancellation, your account reverts to the Free tier and your data is preserved.

6. Free trial

New users receive a 21-day free trial of Sharpnd. Pro. No credit card is required to start a trial. At the end of the trial, your account automatically converts to the Free tier unless you choose to subscribe to Pro. Trial eligibility is limited to one trial per person.

7. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Submit false or misleading practice data to manipulate leaderboards or XP calculations.
• Reverse-engineer, copy, or redistribute the Service or any part of it without our written permission.
• Use automated tools to access the Service in a way that places undue load on our systems.
• Harass other users or post offensive content in any public-facing area of the Service.

Violation of these rules may result in suspension or permanent termination of your account.

8. Your content

You retain ownership of the practice data and content you submit to Sharpnd. By using the Service, you grant us a limited licence to store and process your data for the purpose of providing the Service to you. We do not claim ownership of your data and will not sell it to third parties.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that any specific results will be achieved through use of the Service. Golf improvement depends on many factors beyond our control, including user effort, physical ability, and course conditions.

10. Limitation of liability

To the maximum extent permitted by applicable law, Sharpnd. and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability to you for any claim arising from these terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 CAD, whichever is greater.

11. Termination

We reserve the right to suspend or terminate your account if you violate these terms or if we reasonably believe your use of the Service poses a risk to other users or to the integrity of the platform. We will make reasonable efforts to notify you before taking such action, except where immediate action is required.

12. Governing law

These terms are governed by the laws of the Province of Nova Scotia, Canada, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Nova Scotia, Canada, and you consent to the personal jurisdiction of those courts.

13. Changes to these terms

We may update these Terms of Service from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify you by email or via an in-app notice. Continued use of the Service after the updated terms take effect constitutes your acceptance of the new terms.
